REFUND & REPLACEMENT POLICY
1Overview
This Refund and Replacement Policy governs all recruitment engagements undertaken by GodScale. It is to be read in conjunction with the signed Engagement Letter or Service Agreement between the client and GodScale. In the event of any conflict between this policy and the signed Engagement Letter, the Engagement Letter shall prevail.
By engaging GodScale's recruitment services, the client confirms acceptance of the terms outlined herein.
2Refund Eligibility
GodScale will issue a refund only where it has been unable to fulfil the hiring requirement as defined below.
A hiring requirement is unfulfilled solely if GodScale fails to present a minimum of three (3) qualified, shortlisted candidates matching the original agreed job brief within the mutually agreed timeline.
Refunds will not apply under any of the following circumstances:
- The client modifies the job requirement, compensation structure, or role scope after the engagement has commenced
- The client rejects presented candidates without documented, reasonable justification
- The client causes delays through non-cooperation, delayed feedback, or unavailability for interviews
- The hiring requirement is placed on hold or cancelled by the client after sourcing has begun
- The client independently hires a candidate sourced or introduced by GodScale outside of the formal process
3Partial Refunds for Bulk Hiring
Where GodScale partially fulfils a bulk hiring mandate, a partial refund will be calculated strictly on a per-position basis at the per-head rate agreed in the signed Engagement Letter.
No adjustment, concession, or additional refund be made based on the effort, time invested, complexity of individual roles, or the seniority of positions filled. Only unfilled positions, as counted against the original mandate, will qualify for refund consideration.
4Non-Refundable Services
The following are strictly non-refundable under all circumstances:
- Fees paid in relation to candidate replacement requests
- Fees for roles where sourcing, screening, or shortlisting has commenced, and the client withdraws or cancels the requirement
- Any administrative, retainer, or consultation fees agreed upon in the Engagement Letter
5Replacement Guarantee
GodScale offers a ninety (90) day replacement guarantee on all permanent placements, subject to the conditions outlined in this section.
5.1 Replacement Window
The 90-day replacement window begins on the candidate's confirmed first day of employment, as evidenced by the joining confirmation shared with GodScale in writing. The window will not be paused, extended, or reset for any reason.
5.2 How to Submit a Replacement Request
All replacement requests must be submitted officially via email to service@thegodscale.com and must include all of the following:
- The candidate's full name and position title
- The candidate's confirmed date of joining
- A specific, written reason for the replacement request
- Supporting documentation where applicable, such as a resignation letter, termination notice, or performance record
Incomplete requests will not be accepted. The 90-day window will not be paused pending resubmission of an incomplete request. It is the client's responsibility to ensure all required information is provided within the eligible period.
5.3 Replacement Limit
GodScale will provide a maximum of one (1) replacement candidate per original placement. If further replacement is required beyond this, it will be treated as a new engagement and billed at the prevailing rate.
6Exclusions from Replacement Guarantee
The replacement guarantee is void and no replacement will be provided in the following circumstances:
- The role is part-time, freelance, or contractual in nature
- The employment requirement for the role is less than six (6) months
- The replacement request is submitted after the 90-day window has lapsed
- The candidate's exit is attributable to the client, including but not limited to: failure to provide agreed compensation or benefits, misrepresentation of the role after joining, hostile or unsafe work environment, or non-adherence to terms communicated during the hiring process
- The candidate's departure is due to organisational restructuring, role elimination, or company-wide layoffs
- The candidate resigned for personal reasons unrelated to the role or work environment
- The request does not meet the submission requirements outlined in Section 5.2
7Refund Processing
Refunds approved by GodScale will be processed within seven (7) to ten (10) business days from the date of written confirmation of eligibility. Refunds will be credited solely to the original payment method used at the time of engagement. GodScale will not issue refunds via alternative payment channels.
8Dispute Resolution
In the event of a dispute regarding refund or replacement eligibility, both parties agree to first attempt resolution through written communication within fourteen (14) calendar days of the dispute being raised.
GodScale's assessment of fulfilment, based on documented sourcing records, candidate submissions, and communication history, shall be considered the primary reference point in any such dispute.
If resolution is not reached within the 14-day period, both parties agree to escalate the matter through the dispute resolution mechanism specified in the signed Engagement Letter.
9Policy Amendments
GodScale reserves the right to amend this policy at any time. Any changes will be published on our website at www.thegodscale.com with a revised effective date. Continued engagement with GodScale's services following such changes constitutes acceptance of the revised policy. Amendments will not apply retroactively to engagements already in progress under a signed Engagement Letter.
